Terms & Conditions of Service

1) Identity & Scope
The Vault Marbella Club (“TVMC”) provides concierge and intermediation services arranging reservations and experiences with independent providers (restaurants, clubs, beach clubs, yachts, private jets, vehicles, villas, event venues, etc.). These Terms govern your use of our site and services.
2) Acceptance
By requesting a booking or using our services, you accept these Terms and our Privacy & Cookies Policies. If acting for a company, you confirm you have authority to bind it.
3) Intermediary Nature of Service
The service contract is formed between you and the provider. TVMC is not a party to that contract and does not perform the end service. Provider terms (cancellation, deposits, minimum spend, dress code, schedules, legal requirements, etc.) apply and prevail.
4) Reservations & Confirmations
You authorize TVMC to act on your behalf before providers. Confirmations are subject to availability and acceptance of provider conditions. We may request additional data (ID, payment method, ages/licences, etc.).
5) Prices, Payments, Taxes & Invoicing
Provider sets prices, taxes and charges. TVMC may charge non-refundable concierge/handling fees and/or collect deposits. Unless stated otherwise in writing, the provider issues the invoice for the end service; TVMC invoices only its fees.
6) Changes, Cancellations & No-Show
Written requests within provider deadlines. Provider policies apply. No-show/late arrival may incur full charge per provider policy. TVMC fees are non-refundable except for TVMC error.
7) Refunds
Any refund is determined and issued by the provider via the original payment method. If TVMC collected funds on the provider’s behalf, refunds are processed only with the provider’s explicit written authorization. TVMC does not assume refunds for provider services.
8) Client Requirements & Conduct
Hold required documentation and comply with provider rules, safety instructions and law. You are liable for damage, loss, extraordinary cleaning, over-consumption, overtime and penalties caused by you/your guests.
9) Force Majeure & Operational Causes
Provider (and TVMC as intermediary) may modify, relocate or cancel for safety, weather, breakdowns, strikes, authority orders or force majeure. Reasonable alternatives will be sought; any eligible refund is determined by the provider.
10) Limitation of Liability
To the maximum extent permitted by law, TVMC is not liable for execution of the end service, provider decisions on admission/cancellation/refunds, indirect or consequential damages, or third-party acts. Any TVMC liability is limited to the TVMC fees actually paid in the 12 months prior to the incident.
11) Indemnity
You agree to indemnify and hold harmless TVMC from claims, damages, sanctions or costs arising from breach of these Terms/provider rules, damage by you/your guests, or misuse of the services.
12) Chargebacks
Unfounded chargebacks may lead to service suspension and recovery of bank/processing fees and costs. Use the complaint channel first (Section 15).
13) Intellectual Property & Site Use
Site content is protected. Any reproduction/distribution/transformation requires prior written consent. Third-party brands belong to their owners.
14) Data Protection
Personal data are processed per our Privacy Policy. By using the services, you consent to processing necessary to manage bookings with providers.
15) Support & Complaints
Day-of-service issues: contact the provider on site and notify TVMC immediately so we can assist. Post-service complaints: write within 48 hours; TVMC will forward to the provider. Contact: thevaultmarbella@gmail.com
16) Changes to the Terms
We may update these Terms; the current version will be published with its effective date.
17) Governing Law & Jurisdiction
Spanish law applies. Courts of Málaga (Spain), without prejudice to mandatory consumer rights.
18) Severability & Entire Agreement
If any clause is invalid, the rest remains in force. These Terms constitute the entire agreement regarding their subject matter.
